Gay Marriage or Same-Sex Marriage

When I first began writing about same-sex marriage on this site, I used the term gay marriage to refer to unions meeting this description. I did so for two reasons: The term gay marriage is much more common, so readers are more likely to go to Google or another search engine and type gay marriage than they are to type same-sex marriage. Since I wanted readers to be able to easily find my writing on the subject, I went with the more common phrase.I had no objection to the phrase, since the only people I knew who were interested in same-sex marriage identified as lesbian or gay or identified as bisexuals in lesbian or gay relationships. Some readers took me to task for this. At first, I was skeptical--some of my friends in the LGBT rights movement use the phrase gay marriage, and I was reluctant to switch terminology before the disenfranchised community itself did. I was reminded of the infamous Native American debacle, in which non-indigenous writers thought they were being sensitive by describing native American tribes as Native American rather than American Indian--not realizing that the majority of native Americans used the term American Indian, and preferred to be described as such.But now Ive switched to same-sex marriage. Why? Four reasons: Same-sex marriages need not actually involve lesbian or gay partners. One or both partners might be bisexual or asexual--or even heterosexual. Its not really any of my business.Likewise, many opposite-sex marriages are technically gay marriages. Gay men and lesbians often marry members of the opposite sex (who might be heterosexual or might also be gay) and for a variety of reasons (denial, mutually agreed-upon financial convenience, or simply to construct a more effective closet, to name three examples that come to mind).There has been so much hostility directed against same-sex marriage under the terminology of gay marriage that the phrase almost sounds like a pejorative now. The more accurate terminology of same-sex marriage has a less painful history.It has become clear to me that in recent years the gay rights movement has largely adopted the language of same-sex marriage. While not all gay rights activists use the term, there has been a noticeable increase in its use by activis ts, and a decline in the use of the phrase gay marriage, over the past few years. Im not saying that its wrong to use the phrase gay marriage, nor am I promising that I will never use the phrase again. But I think that the phrase same-sex marriage is both more accurate and more sensitive to the concerns of same-sex couples seeking equal treatment under the law.

The majority of world cultures are based around religion and religion comes with many stipulations that are not agreed upon by everyone. In Christian culture, the issue of homosexuality is a conflict that is currently being debated. Pondering the idea of same-sex dealings, people need to take into consideration the fact that unions between two people does not effect outside parties personally; so it should mean next to nothing to them to see two men or two women be bonded by more than plutonic love. The Catholic Church has been active for many centuries. In the early years, the church was the ruling party of the lands in ancient Europe. However, as time progresses, the church slowly lost its power and it was merely there as a support system for its believers. Church theories are known around the world, but as time moves ahead, they continue to loose their value. I believe the churches messages are mere suggestions. Due to the fact that the modern countries have spent an enormous amount of time and money shaping their nations into what they think it should stand for apart from church’s principles. The church and its ideals are not nearly as valuable to the modern world. But when dealing with the issue of same sex unions, it is exactly the opposite, people go by what the church says as if the church is the actual government. It is puzzling to hear people speak of their respective churches and what it stands for, as if that church is the last word on all things of moral impact. Perhaps I am a modernist, but I believe that the government can be the only one to issue judgments upon relationships. The institution of a federal government can actually preside over different aspects of relationships, including marriage. The government has recorded over thousands of different ways married couples are given special status under federal law. It is not fair to limit same-sex couples a variety of benefits just because they are gay. Because the issue of same-sex marriage has become a prominent discussion topic, the Catholic Church decided to publish their opinion on the matter. The Congregation for the Doctrine of the Faith states, â€Å"all Catholics are obliged to oppose the legal recognition of homosexual unions† (Griffiths, 10). The church so blatantly stating all Catholics should be opposed to homosexual unions is absurd. It offers no real reason, other than its contradiction to the bible. The bible is a book written thousands of years ago, and some might argue that it holds no real evidence of its events being true. In addition, the bible itself contains homosexual activity; in the story of Sodom and Gomorrah, homosexual pursuits are very evident. One could go as far as to say that the Catholic Church is boarding hypocritical. Joseph Cardinal Ratzinger states in the Congregation for the Doctrine of the Faith that in every moral disorder, homosexual activity prevents one’s own fulfillment and happiness by acting contrary to the creative wisdom of God (CDF 18). It is unimaginable how the Catholic Church can come to a conclusion such as this, because they know nothing about homosexuality. All the church sees is the general idea of being gay , and therefore misinterprets the entire culture. With a world as diverse as this one, no one can assume they know everything about a topic that they haven’t experienced for themselves. To generalize that someone is unable to be happy is utterly bizarre because they have no real way of knowing what that person is going through. Charles E. Curran and Richard A. McCormick explain it best in their pursuit for homosexuals’ needs to be incorporated into a wider community, for physic-security and well being just as the rest of the people in society (Curran, McCormich, 345). Homosexuals’ needs to be accepted into society is parallel with everyone else’s, because it gives people security and the feeling of acceptance. Most people are able to achieve acceptance through their community, but when homosexuals strive for acceptance within their community, they are shut down for their orientation. It is not right to exclude homosexuals from normal society just because they are different. Sexuality is a defining characteristic of ones life; it carves the path on how one will live the rest of their life. Because sexuality holds such an important place in people’s lives, it should not be able to hold them back in anything they want to do. Of course homosexuality is very different from what was considered the norm hundreds of years ago and therefore still somewhat a taboo topic, but homosexuality is not a bad thing. People who oppose same-sex relations are not willing to take the chance and introduce something different into their lives, and more often than not, it is just an uncomfortable situation that they are unwilling to face. For same-sex couples to be accepted, we, as a society, must put our judgments aside and experience a world where gay people are able to participate in daily life without being oppressed. I suspect that people would not notice a change from how life is today; the idea of same-sex relationships only affect the people who actually take part in such behavior. I honestly believe that homosexuality would not be nearly as big as a problem as it is today, without the influence of the Catholic Church. The church spews out their opinions on all issues, and provide no alternative; it is either their way or not at all. Running Head: Business Entities, Laws, and Regulations Paper Business Entities, Laws, and Regulations Paper Abstract The following paper includes the consideration of control, taxation, and liability issues for two hypothetical businesses as well as legal, regulatory, and risk issues each of the two businesses may face. Also included in this paper is a hypothetical hiring manager scenario in which the hiring manager must choose from numerous applicants who possess various levels of qualification, experience, and education. An applicant must be chosen from the pool of applicants based on the advertisement laced for a Jackhammer operator and any legal or regulatory issues to be considered for each applicant. Restaurant/Bar Scenario According to the scenario, Jose and Lou plan to open a sports bar with the capital investment from Miriam. In this scenario, the three individuals can form a general partnership with all three owning the business. Miriam would be the investing partner with Jose and Lou being the managing partners. Miriam will allow Jose and Lou to control the business and Miriam shares in the business profits. The formation of a general partnership is achieved by meeting four criteria. The criteria are it must e an association of two or more people; those people must be carrying on a business; they must be co-owners; and the business must be for profit. Miriam, Jose, and Lou would be co-owners of a for profit business, a restaurant/bar, thus meeting the four criteria and can form a general partnership. Taxation of general partners is accomplished on each individual partners personal tax return because partnerships do not have a tax liability. A partnership must file an information return with the government explaining the income, or losses, incurred by the partnership (Cheeseman, 2010, p. 255, pp. 2). The reason for an nformation return is for the government to trace the partners income tax returns for correct reporting of income from the partnership. Liability issues the partners must consider when forming a partnership are tort liability, contract liability, and liability of incoming partner(s). Tort liability affects all partners if the lawsuit is the result of actions performed by one of the partners. The partnership is liable for any negligence, breach of trust, breach of fiduciary duty, defamation, fraud, or any other intentional tort (Cheeseman, 2010, p. 256, pp. 2). Contract liability affects all partners because of agency agreement. Partners are agents of the partnership and therefore any agreement entered into by one partner is also entered into by the other partners through the general partnership. Partners are Jointly liable for contracts and debts of the partnership (Cheeseman, 2010, p. 257, pp. A third party suing the partnership must name all partners in the suit or all partners, and the partnership, are free from collection of a Judgment. Therefore, by naming all partners, and the partnership, in the lawsuit, a third party may collect a judgment from any or all of the partners or the partnership. Liability of incoming artners is limited to the investment of the incoming partner for existing debts and obligations. Liability for debts and obligations incurred after becom ing partner is equal to that of the other partners. Laws and regulations the partnership must follow would be the application for, and receiving of, a liquor license to serve alcoholic beverages and liquor by the drink. Also necessary would be the adherence to all health regulations and codes required for a restaurant. As a partnership, the business would also need to have in writing who is responsible for certain activities. Risks the partnership must prepare for ould be the loss of investment capital by Miriam, who should have a written contract with Jose and Lou that all partners are equally liable for losses and profits. Equal liability covers all partners from carrying the bulk of the financial loss should the business fail. Miriam being the investing partner has the most to lose during the initial stages of the business, which is the riskiest time for a new business. Professional Practice Scenario According to the scenario, Akiva and Tara want to open a birthing clinic and take out large loans to finance the business, which is a medical practice. The business would be a partnership of two medical professionals that would allow Akiva and Tara to form a limited liability partnership or LLP. An LLP is beneficial for the partners because each partner is only liable for debts or obligations up to the capital contribution or investments in the partnership (Cheeseman, 2010, p. 274, pp. 1). Forming an LLP begins with filing articles of partnership with the secretary of state of the state in which the LLP is organized. The LLP laws of the state where the LLP performs business govern the partnership. The partnership must follow the state aws and regulations to continue performing business in that state. Many states require an LLP to carry a minimum of $1,000,000 in liability insurance covering negligence, wrongful acts, or misconduct by partners or employees. Taxation of the LLP is the same as in a general partnership. Each partner is required to file their profits or losses on their personal income tax return. As with a general partnership, an LLP is required to file an information return with the government so the income or losses are traceable to the individual partners. Because Akiva and Tara want to open a birthing clinic, they must prepare for iability issues. Liability issues such as malpractice and human resources must be addressed. Carrying malpractice insurance, and paying the premiums, is an important step in a high risk profession such as an obstetrician. Construction Scenario According to the scenario, Surebuild, Inc. is a corporation. Control of the corporation is the Chief Executive Officer or CEO. The CEO extends the power of control to department managers or supervisors who control his or her individual areas. According to the construction scenario, Mel-Lin is the hiring manager for Surebuild, Inc. and therefore controls the hiring department. Andreas Vesalius Essay Andreas Vesalius I. Biography Andreas Vesalius was born on Dec. 31, 1514, in Brussels, the son of Andries van Wesele and his wife, Isabel Crabbe. Vesaliuss paternal ancestors, who hailed from the German town of Wesel, came to Brussels in the early 15th century and became prominent as physicians and pharmacists. His father served as pharmacist to Margaret of Austria and later to Emperor Charles V. His great-grandfather, Johannes Wesalia, was the head of the medical school at the University of Louvain, where Vesalius started his medical studies in 1530. He matriculated as Andres van Wesel de Bruxella. In 1533 Vesalius transferred to the medical school of the University of Paris. One of his two teachers of anatomy there was Johann Guenther von Andernach, a personable man but a poor anatomist. The other was Jacobus Sylvius, who departed from tradition by giving some role to dissecting in anatomical instructions. Both teachers gave in their own ways a telling testimony of their students anatomical expertise. Guenther, in a book published in 1536, recorded in glowing terms Vesaliuss discovery of the spermatic vessels. Sylvius, however, decried violently Vesaliuss daring claim that Galen, the great authority in physiology since classical times, wrote on the inner organs of the body without ever seeing them. Because of the outbreak of war between France and Charles V, Vesalius, a citizen of the Low Countries, which were a part of the Holy Roman Empire, had to leave Paris in 1536. He returned to Louvain, where, at the recommendation of Guenther, Vesalius, still a student, was permitted to conduct public dissections. He also published a Paraphrase of the Ninth Book of Rhazes (Rhazes, also known as al-Rasi, was a Moslem physician of the early 10th century), in which he made a considerable effort to substitute Latin terms for the still heavily Arabic medical terminology. But Vesalius soon became embroiled in disputes with faculty members, evidencing both his genius and his quarrelsome character. He was practically compelled to go the next year to the University of Padua. There Vesalius passed his doctoral examination with such honors in December 1537 that he was immediately appointed professor of surgery and anatomy. In 1538 he published six sheets of his anatomical drawings under the title Tabulae anatomicae sex. The publication was a signal success. Because of the great demand the sheets soon were reprinted, without Vesaliuss authorization, in Cologne, Paris, Strasbourg, and elsewhere. In 1539 there followed his essay on bloodletting in which he first described the veins that draw blood from the side of the torso. This opened the way to the study of the venous values and led ultimately to the discovery of the circulation of blood by William Harvey. II. Works and Writings De Corporis Fabrica In 1543, Vesalius asked Johannes Oporinus to help publish the seven-volume De humani corporis fabrica (On the fabric of the human body), a groundbreaking work of human anatomy he dedicated to Charles V and which most believe was illustrated by Titians pupil Jan Stephen van Calcar, though others believe was illustrated by different artists working in the studio of Titian, and not from Van Calcar himself. A few weeks later he published another version of his opera, entitled De humani corporis fabrica librorum epitome (Abridgement of the Structure of the Human Body) more commonly known as Epitome, with a stronger focus on illustrations than text, so as to help readers easily understand his findings. The actual text of Epitome was an abridged form of his work in De fabrica, and the organization of the two books were quite varied. In this work, Vesalius also becomes the first person to describe mechanical ventilation. Some time after the accession of Philip II to the imperial throne, Vesalius became again one of the imperial physicians. Vesaliuss absence from medical schools showed itself in his Examination of Gabriele Fallopios Anatomic Observations (1561), in which he had to avoid passing judgment on a number of points in Fallopios book because he had no way of verifying them. It is a moot question whether Vesalius used a pilgrimage to the Holy Land in 1564 as a pretext to leave Spain and the imperial court. Some claimed that he went to the Holy Land to study medicinal plants on the plains of Jericho, a topic on which he is known to have discoursed on his way there. Vesalius might have very well made the pilgrimage out of devotion, as did many millions before and after him. Upon his return from Jerusalem he was to take the chair of the suddenly deceased Fallopio in Padua, but he died on the island of Zenta off the Greek coast. III.
